The Supreme Court's denial to hear the case of Nutraceutical v. FDA (May 14, 2007) may prove fatal to the public's free access to dietary supplements. In essence, the FDA is allowed to use the same risk/benefit analysis it applies to drug safety in making its determination as to whether a nutrient is safe for public consumption.
